Capping stack does not dissolve need for unlimited parent company guarantee for oil spills – Opposition Jul 14, 2024 News The capping stack that is now in the country Kaieteur News – The arrival of a capping stack in-country to respond to a blown out well during oil production activities does not dissolve the need for an unlimited parent company guarantee to ensure the country is not left to foot the costs associated with such a disaster. Highlighting this point during the Leader of the Opposition’s weekly press conference on Friday was Economist and Oil and Gas spokesperson for the People’s National Congress Reform (PNC/R), Elson Low. In an invited comment, he told Kaieteur News that it is always important to have safety equipment to be able to respond to a spill, however, these tools cannot be solely depended on to protect the country. Low explained, “It is always of course useful that we have additional safety equipment here in the event of an oil spill; however, there have been instances in the past where safety equipment has not been able to function effectively.” He continued, “Oil spills are notoriously difficult to contain quickly, you would have seen with the Deep Water Horizon spill that there was a failure in fact of the equipment that they brought to cap that well and that failure of equipment led to a prolonging of the oil spill.” To this end, the Opposition made it clear that while the additional equipment will be useful, it is no substitute for an unlimited parent company guarantee and appropriate oil spill insurance. He said, “It (the capping stack) is no substitute for a parent company guarantee and appropriate insurance so we need to continue to push for that and we need to bear in mind that these kinds of safety equipment while useful do not in any way guarantee that the country is insulated all together from an oil spill.” Exxon on Monday commissioned the country’s first capping stack, one of 13 available globally and one of only two in Latin America. A capping stack is a heavy piece of metal equipment that is placed over a blown out well. It acts as a plug, thereby preventing further flow of hydrocarbons. Presently, Guyana has a US$2B oil spill guarantee that was lodged by the operator of the Stabroek Block, ExxonMobil Guyana Limited (EMGL) and partners, Hess and CNOOC. Appeal Court Judge, Justice Rishi Persaud had ordered ExxonMobil Guyana to lodge a US$2B parent and/or affiliate company guarantee as a condition to a stay of execution granted on a lower court’s order. That order, originally issued by High Court Judge, Justice Sandil Kissoon called for an unlimited parent company guarantee to be provided to the Environmental Protection Agency (EPA) by June 10 or the Liza Phase One Project Permit would be suspended. The Guarantee and Indemnity Agreement was lodged by the Stabroek Block partners on June 9, 2023, following an appeal of the ruling by the EPA and Exxon. The government has also applied to join the matter to fight against full oil spill coverage for the country. ExxonMobil, the operator of the Stabroek Block, holds a 45% interest, while Hess Guyana Exploration Ltd. holds 30% interest and CNOOC Petroleum Guyana Limited holds 25% interest. Each Co-Venturer has contributed to the US$2B guarantee, relative to its participating interest in the Stabroek Block. Jamestown Insurance Company Limited is the Guarantor for Hess; while CNOOC Limited, a company organized in Hong Kong and Exxon Equity Holding Company is the Guarantor for CNOOC and Exxon, respectively. Presently, more than 640,000 barrels per day is being produced from three projects in the Stabroek Block. Notably, all three Floating Production Storage and Offloading (FPSO) vessels are producing above the original design capacity, sparking safety concerns among stakeholders, especially as the country does not have the unlimited oil spill guarantee from the parent company. Human Rights breaches in regulatory process for Gas-to-Energy project will be submitted to US EXIM Bank – Civil Society Activist Jul 14, 2024 News Kaieteur News – One month after requesting the production forecast for the Liza One and Liza Two projects in the Stabroek Block, which will supply the Gas-to-Energy (GTE) project with natural gas, the Government of Guyana remains tight lipped, a clear violation of citizens’ right to access to information. Civil Society Activist, Elizabeth Hughes This was recently highlighted by civil society activist, Elizabeth Hughes, who noted that she received neither an acknowledgement nor response from government regarding her latest request for key project details. The activist was keen to note, “Without the requested information we, the citizens of Guyana do not know the life of the oil fields and its associated gas.  Is there a time gap between the life of the fields and the life span of the GTE project?” Hughes told Kaieteur News that since 2022, she has written in excess of 200 letters in pursuit of information related to the project; however, to date she has not received any. Consequently, she said, “These are human rights violations in addition to the non- adherence to our legislation…these human rights violations will be highlighted in submissions to (US) EXIM Bank during this 30-day period to request information, submit information, express complaints and concerns or other.” The government had applied to the United States Export Import (US EXIM) Bank in 2023 for a US$646 million loan to support the construction of the Natural Gas Liquids (NGL) facility and the 300-megawatt power plant. US oil major, ExxonMobil is constructing the pipeline to transport the gas to the facility from the two Floating Production Storage and Offloading (FPSO) vessels. The country’s application for the loan is still pending approval. In February this year, Hughes as well as other activists in Guyana told the Inter-American Commission on Human Rights (IACHR) that the Government of Guyana, ExxonMobil and the Environmental Protection Agency (EPA) has been violating the human rights of citizens in Guyana during the exploitation of oil and gas. Hughes who focused her presentation on the GTE project explained to the Commission, “The GTE project in the making in its current format since 2020 lacks a feasibility study for the Wales location with its 25km of onshore pipeline, and there are no updated pre or feasibility studies since the advent of COVID 19 and the Ukraine war which have skyrocketed world prices.” She pointed out that the human rights of citizens were being breached as there has been a lack of consultation, lack of the right to free, prior and informed consent, failure to provide adequate information, lack of access to any information and non-disclosure of deals for the project. In her interview with Kaieteur News, the activist said government is still to clarify whether the two projects will wind down oil production activities before the end of the commercial life of the GTE project. To this end, Hughes noted that without the release of the commercial agreements which government continue to dodge, citizens will be left in the dark on this factor that can further drive up the cost of the venture. An investigation has been launched by the Ministry into the fatality. Meanwhile, relatives said that news of Navindralall’s sudden death has left them in shock. The blocks he was hired to drop off “The message come to me like a spear to my heart” one relative said before describing the deceased as a very hardworking son, father, and husband. “I can’t believe my ears; I can’t believe a word when I heard your passing, you will surely be missed by all who you touch their heart. Police have since made contact with her. “She recently told detectives that she would make serious efforts to return to Guyana to follow up with her case”, investigators said. Speaking with Kaieteur News on Saturday, Danello has confirmed that police have contacted her but after she decided to publicly come forward with her story three days ago. “Now they are trying to pin the blame on me for not conducting an investigation (translated from Spanish),” the woman said while holding firm to the claims she made that the police had ample time to work on the information she provided them before she left the country. She still believes that police were not really interested in solving the case at the time when she made the report. The Venezuelan woman on Wednesday recounted throwing herself into some bushes aback of Diamond, East Bank Demerara (EBD) on a rainy night after a taxi driver based at a popular city hotel allegedly kidnapped, robbed, shot and left her for dead. The gruesome attempt on her life took place during the evening hours of April 10. Although three months has passed, the bullet is still lodged in the woman’s body. An x-ray seen by Kaieteur News shows that the bullet is lodged in the woman’s back in a region close to her spine. Danello was reportedly robbed of $300,000 cash and an iPhone 15 Pro Max by the taxi driver she trusted. She further alleged that she provided the police with all the details, which she had on the suspect but the detectives were more interested in her personal life rather than the case. As a result, the woman said she was forced to flee Guyana and return to Venezuela because she was fearful for her life and relives the trauma each day. The woman said it was best for her to leave Guyana since the suspect is free and could possibly locate her and try to kill her. However, after reading the news, that Evelyn Alves better known as Fabiana Betancourt, a Venezuelan woman was found shot dead on Sunday at Diamond, she decided to publicise her story. According to Danello, although Alves’ murderer might not be the same man who tried to kill her in April, she believes staying silent could result in the loss of life for other women in vulnerable situations.
