The International Civil Aviation Organization of which Antigua & Barbuda is a member, governs Aviation globally in one of the most comprehensive legal authorities, which each member is required to pass as their own Civil Aviation Laws. Mindful of the complexities of size and budgets of small and otherwise different members, the right to Register a Difference is built into the complex balance between large and small member airports and Aviation legislation.
When Registering a Difference, members are expected to establish that any diversion from the Rule or Regulation will continue to assure all Safety & Security demands.
Whereas on airports the platform of Safety & Security celebrates laws applicable to all Aviation, launched and maintained, the world outside the airport has its own laws which depend on quiet enjoyment. Juxtaposed with Aviation being the main vehicle for tourism, small islands whose only or main economic activity is tourism, fulfilling the demands of ICAO membership requires constant Security oversight.
Rigorous maintenance of airports grounds, preventing overgrowth and places where contraband can be hidden or unauthorized persons gaining access, all are a constant Security demand.
As Antigua moved into Private and Corporate Aviation operating on the Main Terminal & Ramp in the late 1990s the parking of small jets on the fuel outlets became an issue and private and corporate aircraft were first relocated to the end of RWY 10 (Disused), and after their numbers increased, all activity was removed to the main length of the old runway, which was overgrown and derelict.
Having organized the cleaning of the area and resuscitating aircraft movement, and parking for the growing corporate aviation development of its own Fixed Base Operation, American Allen Stanford was sold the lands including leased land to the newly opened locally owned FBO.
Lands within airports are not sold, and if a valid reason exists and the land is used within the airport, it would be required to Register a Difference with ICAO. Whereas the land was specifically sold with all powers of full and unilateral ownership to Stanford, the only demand was that it be used for FBO and ancillary services.
The Airport however did demand an Agreement with the new owner to permit his lands to be operated within the compound of the airport.
Their only failure was in not Registering a Difference with ICAO, and which has invalidated the inclusion of lands privately owned in Antigua’s Airport. As a result all lands on RWY10 not owned by the Airport are really considered outside of Antigua’s Airport’s jurisdiction, and as the Court has ruled, being trespassed illegally.
It is hoped that the new CEO, a professor in Aviation will hasten to look deeply into resolving Antigua’s Airports violations which she will need to uncover, as they have been hidden for years. For Antigua to move forward it must begin to offer Transparency in Aviation, by Registering a Difference to ICAO.
